US Judge Orders Release of Abrego Garcia from ICE Detention

"Since Abrego Garcia's release after erroneous imprisonment in El Salvador, he has been taken back into custody, again without legal justification," Judge Paula Xinis wrote in her ruling.

The situation originates in a mistaken deportation to El Salvador earlier this year, which US authorities later acknowledged was an error. After his return to the United States to face alien smuggling charges, he was held in immigration detention.

In her decision, the judge pointed out that the government does not have a valid removal order, which prevents them from deporting Mr. Abrego Garcia "at this time."
